terms of service

In order to make any transaction, you must agree to the following terms:

Adoptables

  • You are free to modify the design as much as you want.

  • I do not monitor nor associate myself with the usage of my designs, you are free to represent the design however you want. However, be mindful of your own usage as I am not responsible of it and will not resolve any personal disputes (ex: co-owning, trade backs, ect…)

  • Although it is good practice to resell at the original value, my designs can be traded, gifted or resold freely and at any price.

  • Revoking in any form is prohibited. Please trade amongst each other fairly and wisely. This does not apply for refunds and chargebacks.

  • Adding personal TOS over my own is prohibited (ex: adopt shelters)

  • I do not actively monitor people’s usage of their adopts after purchase, however, if I find repeated breach of my TOS, this can result in a block.

  • Backing out from a money offer without valid reason will be considered a fake offer and will result in a block.

  • Once 48h passed without contacting me after an offer, the adopt reopens.

  • All of my designs benefit from 15% off any commission or redesign featuring that adoptable.

Commercial use

What is personal and commercial use?All of my designs are initially sold for personal use. Any activity that generates money or for profit using my design falls under commercial use. Such activities include, but are not limited to, merchandising, v-tubing, creating closed-species, game development, animation shows, ect… If you already own a design, you can retroactively purchase commercial use for the design by submitting a request.Submit your request for a tier evaluationI believe in offering fair opportunity both for smaller artists while respecting the value of my work. In alignment with this, I evaluate starting/small businesses differently and offer them a lower purchase tier. Your request may fall under the following:Tier 1 (Starter):100$ + 150% of the original design priceTier 2 (Standard): 3000$ + 300% of the original design priceTier 3 (Industry): For any industry level use, please contact me directly for discussing fair pricing.Commercial use are not transferable under 1 year of purchase.Although you can transfer designs freely, commercial use purchase have a cool down of 1 year. This means that this purchase cannot be transferred or resold to a new owner unless 12 months have passed from the initial time of purchase. If you are a new owner and did not receive commercial rights, you can contact me. This is to prevent exploitation and transferring of lower tiers purchases.Note that the commercial use purchase of a design does not give you the rights to my artwork. Do not print or use my artwork in any commercial setting without legal arrangements. If you wish to commission me or use the artwork for profit, contact me for price assessment.* If requested retro-actively, price tiers are applicable from time of evaluation request and not from the date of the design purchase.

Commissions

  • Commissions can take up to 1-3 months depending on the complexity.

  • The start date of your commission matches with the first sketch delivery date.

  • Once the price has been confirmed, a PayPal invoice will be sent to your e-mail.

  • A 50% deposit is expected before starting a commission, the other 50% has to be payed once the commission is finalized.

  • A first sketch will be sent to you, this is the time to request major modifications. Minor changes can be made along the way.

  • Major modifications can later be made with additional fee.

  • A png and transparent (if applicable) will be sent to your e-mail once the invoice is fully payed.

  • A full refund can be requested at any point before I start your sketch. Once the sketch is sent, only partial refunds can be discussed.

  • No refunds will be made once the commission is done.

  • Commissions of an OC you do not own will require an explicit proof of consent from the owner.

  • Religious symbols are acceptable for self-portraits/self-insert characters only.

  • I reserve the right to turn down or cancel any commission at any point, proper reimbursement of the deposit will ensue.

Additionnal Terms

  • Do not steal, trace or copy my art and videos, this is an act of plagiarism.

  • Reposts on other platforms (where I do not post) are tolerated with proper credit. Do not attempt to pass my work as your own, do not impersonate me.

  • None of my work is to be used in NFTs or AI software and their derivatives.

  • Discounts are not stackable : only the highest discount will be applied.

  • Any of my work can be used for self-promotional purposes (posting on gallery, social media, etc…) unless asked otherwise for private commissions.

  • At no point should you take credit for designing the adoptable or making the commissioned work.

  • All work is signed, attempting to remove the signature will be considered an act of plagiarism.

Terms are subject to change without notice.

Blocking

  • I do not hold blacklists, however be aware that misconduct is not tolerated and will result in a block.

  • Abusive/problematic behaviours such as spamming, harassing, insulting, fake offering, plagiarizing, etc… targeted at me or others will get you blocked without notice.

  • Blocked users are allowed to view my art and own my designs, but they are prohibited to interact with me or purchase adoptables directly from me.

  • I block and unblock liberally on all platforms.

  • If you wish to purchase directly from me, you can reach out to me after 1 year to ask to be unblocked. Keep in mind this does not make you entitled to be unblocked and will be a case by case situation.

  • SB: Starting bid

  • MI: minimum increment

  • AB: Auto-buy

  • F2E: Free to enter raffles, the winner is random, your chances are increased with the number of tickets entered.

  • FCFS: first come, first served.

  • Gacha batch: adoptable games that allows you to purchase a roll. 1 roll will get you a random design in a batch of characters. These games are FCFS unless stated otherwise (example: roll cooldown).

  • Roll cooldown: temporary pause on rolls to prioritize AB.

  • OTA: offer to adopt, this can vary greatly from money, to characters, to art. This is not FCFS.
